Terms
These are the terms for giftwaves.fm. They're written in plain words rather than legal theatre, but they're still the agreement between you and Giftwaves: using Giftwaves means you're happy with what's below.
The short version
- You tell us about someone. AI writes the words, sings them, and paints the cover.
- You hear the song before you pay, and then you choose the price — any amount, including nothing at all.
- The free preview has a short spoken line mixed into it. The clean file comes the moment you unlock.
- If the song doesn't land, email us within 30 days and you get every cent back.
1.Who you're dealing with
Giftwaves is a business operating from California, United States, and it runs the website giftwaves.fm.
In these terms, "Giftwaves", "we" and "us" mean that business, and "you" is whoever is making the song.
The contact address for Giftwaves is hello@giftwaves.fm. That's the route for questions, refunds, and anything to do with your information.
2.What Giftwaves makes
You answer a few questions about someone you care about — their name, what they are to you, the occasion, the kind of music they like, and a bit of your own story about them. Giftwaves turns that into a song with a cover picture, and gives you a page you can send to them.
You usually get two versions to choose between. They're made fresh for your answers, which also means they can surprise you — see section 10.
3.Pay what feels right — including nothing
There is no fixed price. When your song is ready you hear it first, and then you decide what it's worth to you. The checkout suggests $10, $20 and $30, and there's a box where you can type your own number.
That box genuinely accepts zero. Type 0 and the song unlocks in full: the clean file, the cover, the download, the shareable page — all of it, exactly the same as if you'd paid $30. There's no lesser version, no expiry on the free one, and nothing gets held back later. If money is tight, take the song and go make someone's day.
The one wrinkle is the card networks: they won't carry an amount under fifty cents. So it's either $0, or $0.50 and up. Amounts are in US dollars.
4.The free preview is watermarked
Before you unlock, what you're listening to is a preview with a short spoken line mixed over the music saying it's your Giftwaves song and how to remove the watermark. It's there so the preview can be genuinely free without simply being the finished product.
The clean master — no spoken line, nothing over the music — is what you get when you unlock, at any amount including $0. If you ever unlock a song and the file still carries the watermark, that's a fault, not a policy: email us and we'll send you the clean one.
5.Love it or your money back
If you paid and the song didn't do what you hoped, we'll refund you in full. No argument, no explaining yourself, no "was it technically defective".
- The window is 30 days from the day you unlocked.
- How to ask: email hello@giftwaves.fm from the address you used, or send us the link to your song. One line is enough.
- What happens: we refund the full amount to however you paid — back to your card through Stripe, or back through PayPal. We'll reply within two working days; the money itself usually shows up within a few days, and banks occasionally take up to ten.
- You keep the song. We don't take it back, and we don't switch off your link. It was made for someone you love; deleting it would be a strange thing to do over money.
- If you unlocked for $0 there's nothing to refund — but if something's wrong with the song, tell us anyway and we'll try to fix it.
After 30 days, ask anyway. It stops being a promise and becomes a judgement call, and the answer is usually yes.
If you're a consumer in the EU or the UK, you have cancellation rights of your own. Because you hear the song before paying a penny, that right rarely has anything left to do here — and the 30 days above is more generous than the law asks for. Nothing in these terms takes away a right you can't sign away where you live.
6.Paying
Card payments are handled by Stripe, and PayPal sits underneath as an alternative if you'd rather use that. Your card number, expiry and security code go straight to them — they never touch Giftwaves, and Giftwaves never sees or stores them. What we're told is the amount, whether it went through, and which song it was for.
Both companies handle your payment details under their own terms and privacy policies.
7.The song is made by AI, and here's who by
No human composer writes or sings your song. The lyrics and the cover picture are generated by Google's Gemini models, and the music and vocals by Suno (reached through a service called kie.ai). Your answers are sent to those providers so they can make it, and they handle that content under their own terms.
That's also why two people who write similar things can get songs that resemble each other, and why a song is sometimes not what you pictured. If that happens, section 5 is the answer.
8.What you can do with your song
Once it's unlocked, the song and its cover are yours to keep. Play it, download it, send it to the person it's for, put it on at their party, print the cover, post it wherever you like. Giftwaves doesn't claim ownership of your finished song and won't sell it or license it to anyone else.
What we can't hand you is a commercial guarantee. AI-generated music sits on legal ground that isn't settled yet, the providers above have their own terms about output, and nobody — Giftwaves included — can honestly promise you exclusive rights or a clean commercial licence. So: personal gifting, yes, wholeheartedly. Building a business on the recording, releasing it to streaming services, or putting it in something you sell — that's at your own risk, and you'd want your own advice first.
Giftwaves may keep a copy of songs made through the service, to run it and to fix things when they break. If you'd rather yours wasn't kept, say so and we'll delete it.
9.What you write, and the person it's about
The story you type is the heart of the song, and it's usually about somebody else. By sending it you're confirming it's yours to share — that you're close enough to this person to be telling us their name and your story about them, and to receive the email about their gift.
Please don't send anything unlawful, hateful, or designed to harass, impersonate or expose someone. If you do, we'll stop the song and won't make it.
The gift page has a long, unguessable web address, but anyone holding that link can open it and listen. That's how giving it works — so send the link to the people you mean to, and treat it like the gift itself.
10.What Giftwaves can't promise
Giftwaves is provided as it is. We can't promise the songs will be flawless, original, or exactly what you imagined, or that the site will never be down or a generation never fail. When something does break, tell us — we'd rather fix it than have you quietly give up on it.
11.If things go badly wrong
To the fullest extent the law allows, Giftwaves isn't liable for indirect or knock-on losses from using the service, and its total liability for any claim is limited to what you paid Giftwaves in the twelve months before it. In return, if something you submitted causes a claim against Giftwaves — content that wasn't yours to share, or use of a song that breaks someone's rights — you agree to cover the reasonable costs of dealing with it.
12.Which law applies
These terms are governed by the laws of the State of California, United States. If you have a problem, email us first — almost everything gets sorted that way. If it can't be, it goes to the courts of California, except where the law where you live gives you the right to bring it locally, which it may well do.
13.Age
You need to be at least 13 to use Giftwaves, and old enough where you live to agree to terms like these.
14.Changes
These terms will change as Giftwaves grows up. When something material changes we'll update the date at the top. If a change would affect a song you've already made, it doesn't apply retroactively — the terms you agreed to at the time are the ones that count.
